Linkepy Terms of Use

Important: These Terms of Use apply to business users only (B2B). If you are a consumer, do not use the Services.
1. Publisher & Legal Information
The website https://www.linkepy.com/ and related applications (the “Site(s)”) are published by Linkepy (entity under incorporation), ("Linkepy", "we", "us", or "our").

2. Purpose & Services
Linkepy provides business users (the “User(s)”) with data operations and enrichment services that help update and maintain their customer/prospect/vendor records (the “Data”), including, without limitation, validation, cleaning, deduplication, correction, synchronization, enrichment, and organization (collectively, the “Services”). The Services are described on the Site and in your order form or plan selection (the “Order”).
3. Scope & Acceptance
- By creating an account, clicking “I agree,” or using the Services, you accept these Terms of Use (the “Terms”). Acceptance is full and unconditional. If you do not agree, you must not use the Services.
- These Terms may be supplemented by an Order, a Data Processing Agreement (the “DPA”), and specific service policies. In case of conflict, the following order of precedence applies: (i) the Order, (ii) the DPA, (iii) any specific service terms, then (iv) these Terms.
- The Services are intended exclusively for professionals acting in the course of their trade, business, or profession.
4. Eligibility & Account Registration
- You must be (a) a natural person with legal capacity to bind your business, or (b) a legal entity acting through an authorized representative.
- You must provide accurate, current, and complete information and keep it updated.
- You are responsible for safeguarding your credentials. Any action taken using your account is deemed to be by you. Notify us immediately at [email protected] of unauthorized use.
- We may refuse, suspend, or revoke access where we reasonably believe the Terms, law, or third‑party rights may be infringed.
5. Subscriptions, Fees & Taxes
- The Services are provided on a subscription or usage‑based basis as set out in your Order (monthly or annual unless otherwise stated).
- Fees are stated exclusive of all taxes. You are responsible for VAT/KDV, sales, use, withholding, or similar taxes, except taxes on our income. Where required, we will charge applicable taxes on invoices.
- Billing & renewal. Subscriptions start on the Order date and auto‑renew for successive periods of the same length, unless canceled in accordance with §5.5.
- Price changes. We may update pricing effective on renewal by notifying you in advance.
- Cancellation. You may cancel at any time via the dashboard or by emailing [email protected]. Cancellation takes effect at the end of the current billing period. Periods that have begun are due in full; no refunds or credits are provided unless required by law or expressly stated in the Order.
- Late payments. Overdue amounts may accrue interest at the maximum rate permitted by law and/or access may be suspended after notice.
5A. Payments & Merchant of Record (Paddle)
- Paddle (or another authorized reseller) may act as Merchant of Record for certain transactions. When Paddle is the Merchant of Record, (i) you purchase from Paddle, (ii) Paddle issues the tax invoice/receipt and collects applicable taxes, and (iii) Paddle’s Terms/Privacy apply to the payment process. Service access remains governed by these Terms.
- For queries about charges, VAT, or refunds relating to MoR transactions, please contact Paddle via the instructions on your receipt.
- Where Paddle is MoR, Linkepy does not store or process your full payment card data; payment processing is handled by Paddle and its PCI‑compliant providers.
6. Trials, Beta & Free Plans
- We may offer free trials or free plans at our discretion. We may modify or terminate such offers at any time.
- Beta features are provided “as is” without warranties and may be suspended at any time.
7. Service Description & Integrations
- The Services may connect to third‑party CRMs or tools (e.g., Salesforce, HubSpot, Pipedrive) at your direction. You authorize Linkepy to access and process Data from such systems as necessary to provide the Services (including reading, writing, updating, merging, or deleting Data consistent with your settings).
- You remain responsible for your accounts with third parties and for obtaining any necessary rights, consents, and authorizations.
8. Acceptable Use & Prohibited Content
You must not, and must not allow others to:
- use the Services for unlawful, harmful, or infringing purposes;
- violate privacy, publicity, intellectual property, or other rights;
- transmit malware, interfere with or disrupt the Services or our infrastructure;
- attempt to gain unauthorized access to any systems or data;
- send unsolicited or unlawful marketing communications;
- use the Services to build, train, or improve competing datasets or services;
- resell, rent, or commercially exploit the Services except as expressly permitted;
- bypass usage limits, quotas, or fair‑use policies.
Prohibited Data. You will not submit or process: (i) special categories of personal data, (ii) children’s data, (iii) payment card data subject to PCI DSS, (iv) government‑issued ID numbers (except where legally required and agreed in writing), or (v) any data restricted by export control or sanctions laws, unless explicitly agreed in writing.
9. User Responsibilities & Warranties
- You are solely responsible for the accuracy, quality, and legality of the Data and for ensuring compliance with applicable laws (including GDPR, KVKK, e‑privacy/anti‑spam).
- You represent and warrant that you have provided all notices and obtained all consents necessary to process Data with the Services.
- You will cooperate with Linkepy by providing timely information and access reasonably required to deliver the Services.
10. Intellectual Property
- Linkepy and its licensors retain all rights in and to the Services and Linkepy Materials.
- Except for limited rights expressly granted, no rights are granted by implication. You will not reverse engineer the Services except where prohibited by law.
- You retain all rights in the Data. You grant Linkepy a license to process Data solely to provide and improve the Services and to comply with law.
- You authorize Linkepy to use your name and logo as a commercial reference unless you opt out via [email protected].
11. Privacy, Data Protection & Security
See our Privacy Policy and Data Processing Agreement (DPA). Each party will comply with GDPR, KVKK, and other applicable data‑protection laws.
Security: We implement safeguards designed to protect Data. See /security.
12. Availability, Support & Maintenance
- We use commercially reasonable efforts to ensure availability; maintenance/suspension may occur with notice where practicable.

13. Third‑Party Sites & Content
We are not responsible for third‑party sites or content; they are governed by their own terms.
14. Suspension & Termination
- We may suspend/limit access for security risk, violation of Terms/law, non‑payment, or risk to others.
- Either party may terminate for material breach not cured within 30 days of notice.
- Upon termination, your rights end. One‑time export of Data within 30 days on request; then deletion/anonymization per policy.
15. Indemnification
You will indemnify Linkepy against claims arising from your Data or use of Services in breach of these Terms or law.
16. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY STATED, LINK EPY MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
17. Limitation of Liability
- No liability for indirect or consequential damages, or loss of profits, revenue, goodwill, or data.
- Aggregate liability capped at amounts paid/payable in the 12 months preceding the event, with stated exceptions.
- Nothing excludes liability that cannot be limited by law.
18. Compliance, Export & Sanctions
You will comply with sanctions, export control, and anti‑corruption laws; do not use Services in embargoed countries.
19. Changes to the Services & Terms
- We may modify Services/Terms; material changes notified; effective on next renewal unless stated otherwise.
- Continued use after effective date constitutes acceptance.
20. Governing Law & Dispute Resolution
- Governing law: Republic of Türkiye.
- Exclusive jurisdiction: Istanbul (Çağlayan) Commercial Courts; 30‑day amicable resolution period.
- Injunctive/equitable relief may be sought where appropriate.
21. Miscellaneous
- Entire agreement; severability; assignment; force majeure; notices; language; no waiver; independent contractors.

Implementation checklist before publishing
